General Terms and Conditions of the Skischule Alpin (Status: Okt. 2020)

Unless expressly agreed otherwise, our general terms and conditions apply to all business between the Skischule Alpin and the customers. The object of the company is the operation of a ski and snowboard school with rental.

SKISCHOOL

1. Prices
The course prices including VAT are according to the price list of the season.

 

2. Registration
Due to the Covid-19 pandemic we recommend the online registration for our ski or snowboard courses on our homepage. In exceptional cases you can also register by email, phone or fax. With the registration an obligation arises between the course participant and the Ski School Alpine. Minors can only be registered by their parents or legal guardians. On the registration form, please provide us with the address, the respective course and date. You will then receive a written booking confirmation. A registration is binding.
We reserve the right to cancel the course if a minimum number of participants is not reached. We will of course inform you about this and try to find an alternative.
We use your personal data exclusively for course information and organization (cover letter, confirmation, course schedule and other information).

 

3. Course card
The customer will receive a course card upon payment for the course, which will be handed over to the ski instructor before the course begins. The course card is non-transferable, only valid for the period of time entered and is non-refundable. The ski course days must be taken consecutively. Only paid course tickets are fixed bookings.
A refund of the course card in case of illness or injury can only be granted with a medical certificate.

 

4. Skilessons
If there are less than 5 course participants, the Alpine Ski School reserves the right to reduce ski course times.
A prolongation of the ski course is possible after the 3rd day of the course at the prolongation rate according to the price list.
Children and teenagers under the age of 18 need a written consent of their parents or guardians if they are allowed to ski or snowboard independently without supervision at their own risk after finishing the ski course.

 

5. Disclaimer
The practice of winter sports is associated with risks. Those who participate in offers of the Alpine Ski School agree with their registration that participation in the course is at their own risk and, provided they exercise reasonable care, the ski and snowboard instructors and responsible persons cannot be held liable.
The Ski School Alpine and the associated rental company are not liable in case of accidents (before, during and after the ski lessons or rental) or injuries of the course participants.
As far as no intentional or grossly negligent breach of contract is claimed, the liability for damages is limited to the foreseeable, typically occurring damage. This also applies if the ski school culpably violates an essential contractual obligation. An essential contractual obligation exists if the breach of duty refers to an obligation on the fulfillment of which the customer has relied and could also rely. The liability for culpable injury to life, body or health remains unaffected.
Unless otherwise provided for in the GTC, liability for damages is excluded, regardless of the legal nature of the claim asserted. This applies in particular to claims for damages arising from culpa in contrahendo, other breaches of duty or tortious claims for compensation for property damage in accordance with § 823 BGB. Insofar as liability for damages against the contractual partner is excluded or limited, this shall also apply with regard to the personal liability for damages of employees, workers, staff, representatives and vicarious agents. A change in the burden of proof to the disadvantage of the customer is not associated with the above provisions.
When registering for a course, the customer must inform the Ski School Alpine about his abilities and experience in the corresponding snow sport (ski, snowboard, cross-country skiing) truthfully and comprehensively.
Please have your own ski equipment checked before the start of the course. It is especially important to have a properly functioning and correctly adjusted safety binding with ski stoppers. The instructors of the Alpine Ski School are not liable for damages due to incorrectly adjusted or faulty equipment.
Each participant bears the risks typically associated with the sports activities themselves. The participant is advised to take out personal insurance cover. In addition, accident, personal liability, daily sickness allowance and occupational disability insurance are recommended.
Punctual arrival at the meeting point (ski course, private lessons) is the responsibility of the client. The ski school is not liable for late arrival at the agreed meeting point. In case of cancellation during a service in progress or non-attendance at the agreed date, there will be no refund or credit of the course fee.
All accidents, involvement in accidents and cases of damage (personal injury/property damage) which occur during the rental period (ski rental) or during the ski course (ski school) must be reported in writing to the ski rental or the Alpine Ski School within 24 hours. Otherwise the customer irrevocably waives claims of any kind against the ski school or the rental company.

 

6. Cancellation conditions / withdrawal / cancellation / force majeure
Cancellation of the booked course by the customer is free of charge up to 2 days before the start of the course. Cancellations after 9:00 a.m. on the previous day will incur 100% of the course fees. A refund of the course ticket in case of illness or injury can only be granted with medical confirmation.
In case of non-attendance at the agreed date or in case of cancellation of a current service no refund will be made.
The ski school tries to create the best possible external conditions for its services, but naturally cannot guarantee these. If unusual weather or snow conditions make the provision of the booked services completely or partially impossible, the ski school does not accept liability for the loss of services. The ski school is under no circumstances liable or obliged to pay compensation for failures of the cable car and lift facilities or services which are cancelled as a result.
We reserve the right to cancel the course if a minimum number of participants is not reached. We will of course inform you about this and try to find an alternative.

 

7. Regulations in connection with Covid-19 / Cancellation / Cancellation / Withdrawal
The customers can view the hygiene and protection concept of the Alpine Ski School on our homepage at any time and get information. The same applies to our instructors. The valid distance and hygiene rules must be observed. The customer confirms to Skischule Alpin by his signature before the start of the course that he has not been in any risk area (according to the RKI list) in the last 14 days, that he is currently not in quarantine, that he does not show any symptoms associated with Covid-19 and that he has not had any contact with proven positively infected Covid-19 sufferers in the last 14 days before the start of the course. The customers are obliged to inform the Ski School Alpine immediately and truthfully in case of infections or symptoms. Covid-19 infected or people with Covid-19 occurring symptoms cannot participate in the course. The ski school can order an exclusion from participation in courses at any time in the case of an existing infection or symptoms. Therefore the regular cancellation conditions apply in case of cancellation by the ski school. In the case of cancellation by the customer in the case of an infection or symptoms, the cancellation conditions apply through cancellation by the customer. For customers under 18 years of age, this confirmation must be signed by their legal guardian. Further measures can be found in our hygiene concept.

 

8. Payment
The payment of course and rental fees is done by cash or EC payment before the course starts in the ski school or by bank transfer with online registration.

 

9. Lift fees
The costs for lift tickets and ski equipment are not included in the course fee.

 

10. Data protection
We use your personal data exclusively for course information and organization (cover letter, confirmation, course schedule and other information).

 

11. Place of jurisdiction / legal venue
The place of jurisdiction is Garmisch-Partenkirchen. The parties agree that German law shall apply.

 

SKIRENTAL

1. Rental of equipment only against deposit (identity card (EU), passport or deposit).

2. The customer confirms with his signature the correctness of the rental or loan contract (number of equipment, date of the first day of rental, etc.). Later complaints are excluded.

3. Remember your ski no. and memorize your equipment to avoid confusion.

4. Do not remove the numbers / barcodes on the ski. Use of the equipment must be stopped immediately if it no longer functions properly. Equipment is generally only rented under our conditions (terms and conditions).

5. Careful and responsible handling of the equipment is mandatory. Do not ski or snowboard over closed slopes, roads, paths or parking lots. These recognizable damages to the base will be charged to you with at least 20,- € upwards. Damaged or missing equipment will also be charged to you (breakage, loss, damage of any kind exceeding normal wear and tear). The customer has the right to prove lower expenses of the ski school.

6. The Skischule Alpin does not take back any external equipment.

7. With the return, each day which has begun counts as a full day of rental.

8. The Skischule Alpin cannot carry out any assembly or adjustment of third-party bindings/equipment for insurance reasons. Sports stores are the competent contact in these cases.

9. In case of loss through theft or total loss of the rented equipment, the customer will be charged the market value of the rented equipment.

10. The place of jurisdiction is Garmisch-Partenkirchen. The parties agree that German law shall apply.
